GENERAL TERMS AND CONDITIONS B&B STIELTJESKANAAL / BIJ AQUAMARIJN

1 APPLICATION
1.1 These General Terms and Conditions apply to all offers, reservations, and agreements relating to all accommodations, camping pitches, and other facilities rented and offered by B&B Stieltjeskanaal / Bij Aquamarijn.
1.2 In these General Terms and Conditions, the terms "renter" and "you" refer to the person who enters into an agreement with B&B Stieltjeskanaal / Bij Aquamarijn regarding the rental/use of accommodation and/or camping pitch and/or other facilities. The term "user" (hereinafter also referred to as "guest") refers to the renter and the persons specified by the renter who (will) use the accommodation and/or camping pitch and/or other facilities rented by the renter.
1.3 These General Terms and Conditions apply regardless of your (prior) reference to any of your own terms and conditions or to other general terms and conditions. B&B Stieltjeskanaal / Bij Aquamarijn rejects all general terms and conditions to which you refer or that you use.
1.4 Agreements deviating from these General Terms and Conditions are only valid if agreed in writing.
2 RESERVATIONS
2.1 B&B Stieltjeskanaal / Bij Aquamarijn only accepts reservations from persons aged 18 or older. Reservations made by persons under this age are therefore not valid.
2.2 B&B Stieltjeskanaal / Bij Aquamarijn reserves the right to refuse reservations deviating from these terms and conditions, particularly for groups, without giving reasons, or to impose special conditions.
2.3 If B&B Stieltjeskanaal / Bij Aquamarijn accepts your reservation, it will send you a confirmation within 14 days of making the reservation. You must check this confirmation for accuracy immediately upon receipt. Any inaccuracies must be reported immediately to B&B Stieltjeskanaal / Bij Aquamarijn.
2.4 If you do not receive confirmation within 14 days of making your reservation, you must contact us immediately. Failure to do so will result in no recourse to the reservation.
2.5 An agreement between you and B&B Stieltjeskanaal / Bij Aquamarijn is concluded when B&B Stieltjeskanaal / Bij Aquamarijn confirms your reservation.
2.6 This agreement concerns the rental of accommodations and/or a camping site and/or other recreational facilities, which are short-term in nature.
3 YOUR AGREEMENT
If your reservation cannot proceed, in whole or in part, because the business is (fully or partially) closed in order to comply, at the discretion of B&B Stieltjeskanaal / Bij Aquamarijn, with guidelines and/or instructions from the (local) government or relevant public health authorities, you will receive a voucher equal to the amount you paid for the reservation. This voucher is valid for 12 months and can be used as payment for a new reservation. Offering a voucher under these circumstances is part of the agreement and does not constitute a change to it.
4 CHANGES TO THE AGREEMENT
4.1 If, after the agreement has been concluded, you wish to make changes to it, B&B Stieltjeskanaal / Bij Aquamarijn is not obligated to accept them. It is at B&B Stieltjeskanaal / Bij Aquamarijn's sole discretion to determine whether and to what extent these changes will be accepted. If B&B Stieltjeskanaal / Bij Aquamarijn accepts your changes, B&B Stieltjeskanaal / Bij Aquamarijn may charge you a change fee.
4.2 If, after the conclusion of an agreement, you wish to reduce the number of nights, accommodations, and/or camping pitches, the cancellation policy, as described in Article 14 of our General Terms and Conditions, applies.
4.3 If, due to other circumstances, B&B Stieltjeskanaal / Bij Aquamarijn needs to make a change to a reservation you have booked, regarding the period of stay or the type of accommodation, B&B Stieltjeskanaal / Bij Aquamarijn can offer you a suitable alternative.
5. SUBSTITUTION
5.1 The tenant and other users are not permitted to transfer the use of the accommodation and/or camping pitch, under any name and for any reason whatsoever, to anyone other than those named in the agreement, unless otherwise agreed in writing with B&B Stieltjeskanaal / Bij Aquamarijn.
5.2 If you and B&B Stieltjeskanaal / Bij Aquamarijn have agreed that you and/or one or more users will be replaced, you, in addition to the tenant and/or users replacing you and/or other users, remain jointly and severally liable to B&B Stieltjeskanaal / Bij Aquamarijn for payment of the outstanding portion of the rental fee, the modification costs (see Article 4.1), any additional costs resulting from the replacement, and any cancellation fees. 6 PRICES
6.1 You owe B&B Stieltjeskanaal / Bij Aquamarijn the agreed rental price, as stated in the booking confirmation, plus the costs of other rented and/or purchased products and/or services.
6.2 Price discounts and/or special offers can no longer be used if the booking confirmation has already been sent by B&B Stieltjeskanaal / Bij Aquamarijn.
6.3 All prices, where applicable, include VAT, unless stated otherwise.
6.4 B&B Stieltjeskanaal / Bij Aquamarijn reserves the right to implement and settle price increases (including retroactively) resulting from interim changes to statutory regulations or provisions (including, but not limited to, VAT and tourist tax) over which B&B Stieltjeskanaal / Bij Aquamarijn has no control. 7 ADDITIONAL COSTS
7.1 In addition to the rental price, you/the renter are also liable for tourist tax and the costs of any optional extras booked.
7.2 The tourist tax contribution is determined by the relevant municipality of the location. You/the renter are always liable to pay B&B Stieltjeskanaal / Bij Aquamarijn the applicable tourist tax rate set by the relevant municipality.
8 PAYMENTS
8.1 For stays of 3 consecutive nights or more and/or bookings of 3 accommodations or more, a deposit of 30% of the total rental amount must be paid within 7 days of booking. The remaining 70% of the rental amount, plus any other rented and/or purchased products and/or services, must be paid upon check-out at B&B Stieltjeskanaal / Bij Aquamarijn.
8.2 Payment by invoice is only possible with the explicit prior consent of B&B Stieltjeskanaal / Bij Aquamarijn and is not possible for private individuals.
9 ARRIVAL AND DEPARTURE
9.1 The rented accommodation/camping pitch can be occupied from 2:30 PM on the agreed arrival date, as stated in the booking confirmation. On the agreed departure date, as stated in the booking confirmation, the accommodation must be vacated by 10:30 AM.
9.3 If the use of the accommodation and/or camping pitch is terminated earlier than the agreed date stated in the booking confirmation, the tenant is not entitled to a refund of (part of) the rental price and/or costs from B&B Stieltjeskanaal / Bij Aquamarijn. If you have travel insurance and meet the conditions set by the insurance company, you can submit a claim for damages arising from the early termination of your stay directly to the insurance company.
10 RULES
10.1 All guests must adhere to the rules established by B&B Stieltjeskanaal / Bij Aquamarijn, as laid out in, among other things, the House Rules & Agreements. You can find a copy of these at your accommodation and on the website, or you can request them at check-in.
10.2 In accordance with local regulations, all guests are required to provide proof of identity upon request at check-in. If guests cannot provide proof of identity, B&B Stieltjeskanaal / Bij Aquamarijn may decide not to accommodate them.
10.3 Each accommodation may only be occupied by the maximum number of people stated for that accommodation on the B&B Stieltjeskanaal / Bij Aquamarijn website.
10.4 The "Uniform Conditions for the Hospitality Industry" apply to the catering services and agreements provided. A copy of these conditions is available upon request.
10.5 B&B Stieltjeskanaal / Bij Aquamarijn reserves the right to make changes to the layout and opening hours, including partial or complete closure, without entitlement to compensation. 10.6 For necessary maintenance, you will allow work to be carried out on the accommodation or other facilities during your stay, without any right to compensation.
10.7 For safety reasons, tents are not permitted near the permanent accommodations. This is permitted on camping pitches, provided this has been agreed upon during the reservation/booking process.
10.8 The tenant must leave the camping pitch clean (i.e., do not leave any garbage on the pitch, but place it in the appropriate garbage bags in the container).
10.9 In the event of violation of the rules contained in these General Terms and Conditions, the House Rules & Agreements, and/or failure to follow instructions from staff, B&B Stieltjeskanaal / Bij Aquamarijn has the right to immediately remove you, the tenant, and any other user from the premises, without refunding the rental fee or any part thereof.
10.10 If the owners seriously suspect that the tenant of an accommodation is acting contrary to the law and/or public order and/or morality, or in the event of an unsafe situation, they are authorized to enter the accommodation. 10.11 Normal use of water and electricity (daily use = 3 kWh) is included in the rental price.
The use of large electrical appliances, such as ovens, deep fryers, and air fryers, is not permitted. If excessive electricity consumption is detected, a charge will be made.
11 PETS
11.1 Only dogs are allowed at B&B Stieltjeskanaal / Bij Aquamarijn.
11.2 Depending on the accommodation and/or campsite, a maximum of one or two dogs belonging to the tenant or users are allowed at B&B Stieltjeskanaal / Bij Aquamarijn. If you and/or other users wish to bring pets, you must inform us of this before arrival. In that case, B&B Stieltjeskanaal / Bij Aquamarijn will determine whether this is possible and what surcharge will be charged. B&B Stieltjeskanaal / Bij Aquamarijn reserves the right to refuse pets on the premises (without stating a reason). 11.3 Pets are only allowed in the farmhouse, dining and living room, toilet, and shower facilities after consultation. Pets must be kept on a leash outside the accommodation, on the grounds. Instructions on site must be followed. Pets must not cause a nuisance to other guests.
11.4 Dogs must bring a dog basket or crate, and flea protection is required; drops, pills, or a flea collar are sufficient.
11.5 Pets must not be left unattended in an accommodation.
12 USE OF ACCOMMODATION EQUIPMENT
12.1 The tenant/user and those accompanying the tenant are each jointly and severally liable for the proper conduct of affairs in and around the rented accommodation, camping pitch, and/or elsewhere on the grounds, and for the use of the accommodation and/or camping pitch and the equipment present therein. 12.2 In addition, the tenant/user and any accompanying person are always jointly and severally liable for damage due to breakage and/or loss and/or damage to inventory and/or accommodation. Any damage must be reported immediately by the tenant to B&B Stieltjeskanaal / Bij Aquamarijn and, if necessary, compensated on-site, unless the tenant can demonstrate that the damage was not attributable to their own fault, other users, or any member of their party.
If, after the guest checks out, it appears that there is unreported damage to the accommodation and/or inventory that was demonstrably caused by the guest, the costs will still be charged.
13 INTERNET USE
13.1 B&B Stieltjeskanaal / Bij Aquamarijn offers the tenant/user and any accompanying person access to the internet via a Wi-Fi network. 13.2 The renter is responsible for the correct use of the internet, as well as the necessary hardware and software, configuration, peripherals, and connections to support it, and for taking security measures for the computer or operating system.
13.3 B&B Stieltjeskanaal / Bij Aquamarijn is not liable for damage resulting from internet use or network disruptions.
13.4 The renter/user and those accompanying them must conduct themselves as expected of a responsible and careful internet user when using the internet, must respect legal regulations, and refrain from any behavior that causes inconvenience to other internet users or harms B&B Stieltjeskanaal / Bij Aquamarijn in the broadest sense of the word. The renter/user and those accompanying them will refrain from visiting websites that are unlawful in nature or that are inconsistent with the reputation of B&B Stieltjeskanaal / Bij Aquamarijn as a provider of accommodation and/or camping pitches.
13.5 If the tenant/user or anyone accompanying the tenant discovers or suspects any nuisance to third parties and/or (other) internet misuse, B&B Stieltjeskanaal / Bij Aquamarijn reserves the right to block internet access, either in whole or in part, without prior notice.
13.6 The tenant indemnifies B&B Stieltjeskanaal / Bij Aquamarijn against claims from third parties for compensation for damages that these third parties could (attempt to) recover from B&B Stieltjeskanaal / Bij Aquamarijn in any way, insofar as this claim is based on the use of the internet by the tenant/user and anyone accompanying the tenant.
14 CANCELLATION FEES
14.1 If a reservation made via the website "www.bij-aquamarijn.nl" or in person with B&B Stieltjeskanaal / Bij Aquamarijn via email, verbally, or by telephone is cancelled, cancellation fees will be charged. We apply the following cancellation fees:
* Cancellations made within 24 hours of booking – no fee (except for bookings made within 48 hours of arrival).
* Cancellations made up to 6 weeks before arrival: €25.00.
* Cancellations made 6 to 4 weeks before arrival: 30% of the total price.
* Cancellations made 4 weeks to 48 hours before arrival: 70% of the total price.
* Cancellations made within 48 hours before arrival: 100% of the total price.
You will receive an invoice for payment of the cancellation fee.
14.2 Reservations made through (a booking platform of) third parties – such as, but not limited to, Natuurhuisje, SVR, Booking.com, and Expedia.com – are non-refundable. The cancellation fee is 100% of the total price. 14.3 If you fail to arrive within 24 hours of the agreed date without further notice, this will be considered a cancellation (no-show). In that case, you will be liable for the full total amount.
14.4 Deposits, after any deductions as mentioned in 14.1, will be deposited into the account number known to us within 30 days.
14.5 Group packages (this also includes packages without accommodation, such as BBQs, parties, etc.), group reservations (more than 3 accommodations), reservations for accommodations held under option, and/or custom-made reservations cannot be canceled free of charge. The agreed-upon conditions apply in each situation, with a minimum of 10% of the invoice price.
15 FORCE MAJEURE AND CHANGES
15.1 In the event that B&B Stieltjeskanaal / Bij Aquamarijn is unable to fulfill the agreement in whole or in part, either temporarily or permanently, due to force majeure, B&B Stieltjeskanaal / Bij Aquamarijn may submit a proposed amendment (for a different accommodation/different period, etc.) within 14 days of becoming aware of the inability to fulfill the agreement. B&B Stieltjeskanaal / Bij Aquamarijn may suspend its obligations if circumstances beyond its control arise. Under no circumstances will B&B Stieltjeskanaal / Bij Aquamarijn be liable for any damages or costs. 15.2 Force majeure on the part of B&B Stieltjeskanaal / Bij Aquamarijn exists if B&B Stieltjeskanaal / Bij Aquamarijn is prevented from fulfilling the agreement in whole or in part, temporarily or permanently, due to circumstances beyond the control of B&B Stieltjeskanaal / Bij Aquamarijn, including the threat of war, staff strikes, blockades, fire, flooding, and other disruptions or events.
16 TERMINATION
B&B Stieltjeskanaal / Bij Aquamarijn reserves the right to terminate the agreement at any time with immediate effect if personal data of you and/or other users is provided incompletely and/or incorrectly upon reservation. In such a case, no refund of the rental amount or any part thereof will be made.
17 LIABILITY
17.1 B&B Stieltjeskanaal / Bij Aquamarijn accepts no liability for theft, loss, or damage of or to property or persons, of any nature whatsoever, during or as a result of a stay and/or the rental/use of accommodation and/or camping site and/or other facilities of B&B Stieltjeskanaal / Bij Aquamarijn, unless there is intent or gross negligence on the part of B&B Stieltjeskanaal / Bij Aquamarijn or (one of) its employees.
17.2 B&B Stieltjeskanaal / Bij Aquamarijn is not liable for disruptions to services or defects in services provided by third parties.
17.3 You/the renter and each user are jointly and severally liable for all loss and/or damage to the rented accommodation and/or camping site and/or other property of B&B Stieltjeskanaal / Bij Aquamarijn that occurs during the use thereof by you and/or other users, regardless of whether this is the result of actions or omissions by you and/or third parties present on the premises with your permission. B&B Stieltjeskanaal / Bij Aquamarijn may hold you/the renter liable for any damages incurred.
17.4 You/the renter indemnifies B&B Stieltjeskanaal / Bij Aquamarijn against all claims for damages from third parties resulting from any actions or omissions by you, other users, your travel companions, or third parties present on the premises with your permission. 17.5 In the event of improper use or improper leaving of the accommodation, including but not limited to excessive soiling, additional costs will be charged, which you are obligated to pay immediately. B&B Stieltjeskanaal / Bij Aquamarijn can, if necessary, send an invoice for the additional costs afterward.
18 COMPLAINTS
Despite the care and efforts of B&B Stieltjeskanaal / Bij Aquamarijn, you may believe you have a legitimate complaint regarding your holiday accommodation. You should initially report this complaint directly to B&B Stieltjeskanaal / Bij Aquamarijn on-site. If this does not lead to a satisfactory solution, you have up to three months after departure to have the complaint handled by the Recreation Disputes Committee in The Hague or to submit the complaint to the legally competent court. The decision of this committee has the force of a binding opinion.
19 APPLICABLE LAW
The agreement between you and B&B Stieltjeskanaal / Bij Aquamarijn is exclusively governed by Dutch law.
20 TRAVEL DOCUMENTS
You are responsible for having the valid travel documents required for your destination. B&B Stieltjeskanaal / Bij Aquamarijn accepts no liability for any consequences arising from not having the correct travel documents.
21 PRIVACY
All information you provide to us will be stored in a file. This file is used for our guest administration. This information may also be used to provide targeted information and offers about our products and services. A detailed description of how we process your data can be found on our website under the "Privacy" section.
22 GENERAL
22.1 B&B Stieltjeskanaal / Bij Aquamarijn will send its correspondence digitally, unless this proves impossible. 22.2 Obvious printing and typographical errors are not binding on B&B Stieltjeskanaal / Bij Aquamarijn.
22.3 These General Terms and Conditions supersede all previous publications of general terms and conditions.
